Pemerintah mengeluarkan peraturan baru terkait TKI. Kebijakan baru tersebut, tak lain adalah Peraturan Pemerintah (PP) Nomor 3 \u00a0Tahun 2013 tentang perlindungan TKI di luar negeri, yang ditandatangani oleh Presiden Susilo Bambang Yudhoyono \u00a0pada 2 Januari 2013 lalu.<\/p>\n

Kebijakan baru pemerintah terkait kepentingan TKI di luar negeri itu, secara garis besar berisi tentang tiga hal. Pertama, perlindungan TKI dimulai dari sebelum penempatan, masa penempatan, sampai dengan purna penempatan. Kedua, perlindungan TKI dapat melalui penghentian dan pelarangan penempatan TKI. Terakhir, pemerintah juga mengatur tentang program pembinaan dan perlindungan bagi TKI.<\/p>\n

Pada bab I pasal IV disebutkan, \u201cPemerintah bersama pihak terkait dalam penempatan
\ndan perlindungan TKI di luar negeri, wajib memberikan perlindungan secara penuh dan tanpa diskriminasi kepada calon TKI\/TKI.\u201d. Secara kontekstual, pasal tersebut mengandung arti bahwa pemerintah akan ikut serta secara aktif, dalam penanganan masalah TKI di luar negeri.<\/p>\n

Perlindungan terhadap calon TKI yang belum berangkat meliputi perlindungan secara administratif dan secara teknis. Apabila ada seorang warga Indonesia yang ingin bekerja di luar negeri tetapi mendapat kendala, maka pemerintah maupun pihak swasta yang dalam hal ini diwakilkan oleh PPTKIS wajib untuk membantu.<\/p>\n

Saat masa penempatan, perlindungan terhadap TKI dimulai sejak ia tiba di bandara\/pelabuhan negara tujuan penempatan, selama bekerja, hingga kembali ke bandara debarkasi Indonesia. Perlindungan pada masa penempatan dibebankan kepada Perwakilan Republik Indonesia (KBR\/KJRI\/KDEI). Bentuk perlindungan tersebut berupa pembinaan dan pengawasan, bantuan dan perlindungan kekonsuleran, pemberian bantuan hukum, pembelaan atas pemenuhan hak-hak TKI, perlindungan dan bantuan lainnya sesuai dengan ketentuan peraturan perundang-undangan, hukum dan kebiasaan internasional, serta upaya diplomatik.<\/p>\n

Sedangkan perlindungan terhadap TKI purna penempatan, meliputi pemberian kemudahan fasilitas kepulangan TKI, pemberian upaya perlindungan terhadap TKI dari
\nkemungkinan adanya tindakan pihak-pihak lain yang tidak bertanggung jawab dan dapat merugikan TKI dalam kepulangan dari negara tujuan, di debarkasi, dan dalam perjalanan sampai ke daerah asal. Pada proses kepulangan TKI, pemerintah \u00a0juga memfasilitasi pelayanan transportasi, jasa keuangan, jasa pengurusan barang, hingga pemantauan kepulangan TKI sampai ke daerah asal.<\/p>\n

Selain itu, pemerintah juga menyediakan fasilitasi pengurusan klaim asuransi yang merupakan hak bagi TKI. Bentuk pelayanan pengurusan klaim asuransi tersebut, nantinya berfungsi dalam penanganan TKI yang sakit, sehingga mendapat perawatan kesehatan dan rehabilitasi fisik maupun mental.<\/p>\n
