Alasannya, berdasarkan bukti CCTV, DL melaksanakan ibadah sholat saat waktu kerja di rumah majikan. Sang majikan kemudian melaporkan ke DL ke agensi di Hongkong.<\/p>\n<p>Akhirnya, DL dipulangkan ke Indonesia tanpa mendapatkan haknya dan bahkan harus menanggung hutang biaya penempatan KUR PMI dan lainnya sebesar Rp 23.000.000,- (dua puluh tiga juta rupiah).<\/p>\n<p><strong>Dianggap Melanggar Hukum Hong Kong<\/strong><br \/>\nMasalahnya, apakah perbuatan membatalkan kontrak kerja dengan alasan melarang PMI melaksanakan ibadah sholat merupakan perbuatan melawan hukum (<em>tort law<\/em>) menurut hukum Hong Kong? Dan, apakah pekerja migran dapat menuntut ganti rugi?<\/p>\n<p>Alasan majikan membatalkan kontrak kerja PMI karena melaksanakan ibadah sholat jelas melanggar ketentuan Pasal 32 Undang-Undang Dasar Hong Kong (<em>The Basic Law of the Hong Kong Special Administrative Region<\/em>) dan Pasal 15 Peraturan Deklarasi Hak-Hak (<em>Hong Kong Bill of Rights Ordinance<\/em>).<\/p>\n<p>Selama proses pemulangan, DL turut didampingi oleh Serikat Pekerja Rumah Tangga Bersatu (<em>Union of United Domestic Workers<\/em>) Hongkong bersama <em>Justice Without Borders<\/em>. Setiba di tanah air, DL yang didampingi oleh Serikat Buruh Migran Indonesia (SBMI) Wonosobo berhasil menuntut Perusahaan Penempatan Pekerja Migran Indonesia (P3MI) untuk mengembalikan hak DL berupa pelunasan hutang dan pengembalian dokumen.<\/p>\n<p><strong>Hak Santunan Jaminan Sosial Pekerja Migran<\/strong><br \/>\nSelanjutnya, pada Senin, 2 Agustus 2021 DL meminta bantuan Kepala BP2MI agar bisa mendapatkan santunan dari BPJS Ketenagakerjaan untuk PMI. Dilihat dari kasusnya, kasus pembatalan kontrak kerja PMI secara hukum termasuk dalam &#8220;mengalami risiko gagal ditempatkan&#8221; yang dicakup dalam program Jaminan Sosial pekerja migran.<\/p>\n<p>Oleh karena itu PMI DL berhak mendapatkan santunan uang atas risiko gagal ditempatkan sebesar Rp 7.500.000,- (tujuh juta lima ratus ribu rupiah) serta penggantian biaya pengangkutan untuk pemulangan sesuai tiket pesawat udara kelas ekonomi maksimal sebesar Rp10.000.000,00 (sepuluh juta rupiah).
