Tak dapat dipungkiri jika ada majikan yang mungkin berniat jahat atau curang dan memutuskan kontrak dengan alasan-alasan tertentu.<\/p>\n<p>Majikan dapat melakukan pemutusan kontrak dengan memberi pekerjanya surat peringatan atau <em>warning letter<\/em>. Berdasarkan hukum ketenagakerjaan Hong Kong, majikan berhak memutus kontrak tanpa harus ada notice dan uang terminit, jika pekerja terbukti melanggar :<\/p>\n<p>1. Perncurian<br \/>\n2. Penganiayaan<br \/>\n3. Lupa mematikan kompor<br \/>\n4. Memberi obat overdosis<br \/>\n5. Memasukkan orang lain ke rumah tanpa izin<br \/>\n6. Tidak patuh pada instruksi majikan<br \/>\n7. Alasan-alasan lain yang berbahaya dan melanggar privasi majikan.<\/p>\n<p>Kesemuanya tersebut tidak bisa dituduhkan hanya dengan tuduhan lisan. Majikan harus membuktikan tuduhan-tuduhan tersebut secara hukum. Untuk membuktikannya secara hukum, majikan harus mencari bukti dengan memaksa pekerjanya menandatandani <em>warning letter<\/em>.<\/p>\n<p>Jika buruh migran sudah menandatangani <em>warning letter<\/em> sebanyak 3 kali, maka majikan bisa sewaktu-waktu memutuskan kontrak kerja tanpa one month notice dan uang terminit. Untuk itu sebaiknya pekerja migran jangan sembarang tanda tangan kertas yang tak diketahui pasti apa isinya. Lebih baik buruh migran jangan tanda tangan dan membiarkan majikan memutus kontrak kerja.<\/p>\n<p>Jika pekerja tak tahan dengan perlakuan majikan, pekerja bisa memutuskan kontrak lebih dulu dengan memberikan one month notice.
