Di Hong Kong, buruh migran yang hendak memutuskan kerja dengan majikan bisa memberikan surat pemberitahuan satu bulan sebelumnya, atau dikenal dengan istilah one month notice. Surat notice adalah surat pemberitahuan yang berfungsi agar masing-masing pihak (majikan dan pekerja) bisa mempersiapkan diri.<\/p>\n<p>Majikan bisa bersiap untuk menyiapkan keuangan untuk memenuhi hak-hak pekerja rumah tangga. Majikan bisa juga bersiap untuk mencari pengganti pekerjanya. Pekerja rumah tangga bisa keluar dari rumah majikan selang satu bulan setelah surat notice tersebut dibuat dan dilayangkan kepada majikan dan Imigrasi Hong Kong. Berikut ini adalah tips dan cara membuat one month notice kepada Imigrasi Hong Kong :<\/p>\n<p>1. Surat notice bisa ditulis tangan rapi di formulir atau diketik<br \/>\n2. Setelah diisi, surat notice di foto kopi sebanyak dua lembar. Jika tak memungkinkan untuk fotokopi, isi surat notice sama persis sebanyak tiga lembar sesuai panduan.<br \/>\n3. Surat notice asli diberikan pada majikan. Surat notice salinan dikirim pada Imigrasi Hong Kong dengan alamat yang sesuai dengan kertas notice di bagian kiri bawah. Sedangkan sisa salinan notice untuk dipegang oleh pekerja sendiri.<br \/>\n4. Setelah surat notice dikirim ke Imigrasi, dalam jangka waktu seminggu majikan akan menerima balasan pemberitahuan dari Imigrasi Hong Kong yang menyatakan pekerja sudah mengirim notice.<br \/>\n5. Saat mengirim notice ke Imigrasi Hong Kong sebaiknya jangan memakai perangko. Langsung saja datang ke register atau paket kilat dan minta kwitansi pengiriman. Simpan kertas kwitansi tersebut sebagai bukti kita telah mengirimkan notice ke Imigrasi.<\/p>\n<p>Jika majikan tak bersedia menerima surat notice dengan cara mengembalikan, menyobek atau membuangnya, maka pekerja bisa mengirimkan surat notice asli pada majikan melalui jasa pos. Jangan lupa untuk meminta bukti pengiriman dari kantor pos. Tak semua majikan menerima surat notice begitu saja, karena ada juga majikan yang tak terima diberi surat notice.<\/p>\n<p>Majikan yang tak terima dengan surat notice bisa saja mengirim surat PHK dengan keterangan jelek. Majikan juga bisa mengusir atau menuduh pekerjanya melarikan diri dari rumah majikan. Maka untuk menghindari hal tersebut, pekerja sebaiknya mengirim surat notice pada Imigrasi selang beberapa jam sebelum diberikan pada majikan. Jikalau ada tuduhan dari majikan, maka pihak Imigrasi lebih dulu telah menerima surat notice pekerja.<\/p>\n<p>Jika pekerja sudah memberi notice pada majikan, pekerja tidak boleh memutuskan kontrak ditengah tengahnya. Kalau majikan mengusir sebelum notice habis, majikan wajib mengganti sisa notice dengan pembayaran uang tunai.
